Discussion: Due Process Act
« on: June 14, 2011, 05:56:45 AM »
While I'm spamming us up with informal discussion threads like this, I suppose I should bring up the proposal for due process and court cases and such that me and Elu worked a bit on way ago. As a party that values justice, I would think establishing due process would be our prerogative. My first thought looking at it was wow, this is longer than I remember, but then again something as important as this might warrant strict procedures and standards.

It certainly is. The Act could definitely use some grammar fixes, which I may be able to make to the wiki at some point soon.

I also think we should look carefully at Retrials and Obstruction. In particular it may be more effective if the Court can mete out punishments for obstruction on the spot, without a separate trial.

Another possibility I'd considered, if we want to be a bit less picky for the sake of this being a game with certain realities, is to instead of having warrants is to if the government makes an arrest for the matter to be presented to the Court to decide whether there's reason to continue holding them and conduct a trial.

Well, I've done some more work on it and tried to whittle it down to the necessary basics, but there's still work to do be done and I'd like input on whether I've cut out too much. I cut a lot out of the presentation of cases, that's for certain. Do we trust the Court to let people speak XD

Okay, since there wasn't much discussion, and since this should really be accomplished before the elections, the vote on the Due Process Act is up.  Summary of the June-July 2011 Senate: clarified the existing Ministries and Oaths Act, introduced (probably will pass) the Due Process Act.  Proposed business for the next Senate: define procedures, amend Constitution to provide for Schulze voting.

Those sound like good ideas. We also had a whole agenda of possible amendments that we left up for discussion: we should probably resume that congress at some time. On the point of procedures, I think me and Elu drafted something way back when if you want a place to start from.
