Title: Delfos - 1 week ban
Post by: Limitless Events on March 29, 2008, 06:40:12 PM
As of yesterday Delfos was banned for a period of one week due to a second offense at harassing an admin following the issuance of a warning. The first warning was given by GMT 2 months ago for flaming. Following that warning Delfos sent multiple insulting PMs to GMT and another to G-C including multiple vulgarities directed at GMT.
The second warning was issued by myself for his posting of pointless pictures in gov't threads that were on topic. This warning was replied to by Delfos with another angry mob picture and a vulgarity directed at myself and others. Following that Delfos was banned from accessing the forum for a period of one week because of these incidents.

This also signifies a change in policy. From now on harassment of any member will dealt with swiftly and agressively by the admin team.

While at the same time Admin abuse cannot be tolerated, I would like to remind everyone that it's not the fact that delfos posted in a negative manner towards the government that is the issue here. It's the fact that he did so in a manner which was not even an intelligent thought, in a thread that was for taijitu to come together to discuss changes being made, and throw tomatoes at myself and gunner LOL

Taijitu has always, and will always, encourage free speech. But in Delfos' case, he should have at least posted some dialogue along with his picture, or started a separate thread for it. Also, there is not a forum out there that would tolerate Admin abuse the way Taijitu has. Keep in mind that it's the job of the admin to keep the forum rules intact, the forum rules are not subject to the discretion of myself, the Citizen Assembly, or any other government institution.

I would've prefered if this was posted yesterday, but alrighty. I understand the reasoning. One of my major issues at the moment is the apparent lack of a third non-biased party to hear appeals by banned citizens. Will any measures be taken to the end of creating such a body? Or is the Supreme Court still functional? To my recollection the Constitution was dismantled, what of the Laws of Taijitu? Granted, they need dire changes as of now, but can any post be made to specifically outline laws?

There is a key difference between the bans placed upon Delfos and Govindia compared to a ban imposed by the courts. Bans placed by admins because of actions such as harassment, the ToS, ect. are above the court as the extend to actions commited outside of the game the governemtn and courts rule over. As for oversight of these actions there are currently 9 Admins and 2 root admins. Plenty large of a group to ensure that it caries out its duties properly

Frankly the whole idea that admins have absolute power offends me a bit. Who decided who was to become an admin, and why does it seem they all are buddy buddy with each other? That's peoples problems with admins, they all appear to be buddies in agreement on issues and working for themselves.

Anyways, is there any non-admin platform to be implemented in the review of ban appeals? I understand the admins can ban people, but for that very same reason they'd be hesitant to listen to an appeal. Hell, I'd even grant the admins the ability to exercise something similar to Englands Royal Perogative and overrule the bodies vote in cases where they view the appeal as a threat to regional security. People need a bit of security, however.

edit: I should also mention that I have no further qualms with Delfos' 1 week banning, considering his PM'ing actions. I never followed the Govindia trial because I didn't have a comp during the winter, so I won't pretend to understand why he was banned.

That's just it though, Xy, the admin system does not function as part of the government of Taijitu. To a degree, yes, the admins are above the "law" so to speak. But that will be the case on any forum in NS.

The supreme court is still functional. The Citizen Assembly will be up and running soon as well.  I do not think we should give Admins a role in the government, as the two need to be kept seperate (sort of like church and state, and much for the same reasons)
