IPO Forum - International Court
« on: November 11, 2007, 06:31:38 PM »
How should this court be structured? I say, the highest representative from all courts of all members of IPO, as a council court, against subjects or collectives, bearing all the bills created so far for IPO. Or should it be carried by IPO Diplomacy Bureau with a new committee of International Court Judges?

Please can all nations who are part of the IPO send one legal and one governmental representative (along with staff) to the new International Court of the International Peace Organization located in Templarios. Thank you very much.

OCC: What do we want to call this court:
  • International Court
  • Multinational Court
  • International Criminal Court
  • Multinational Criminal Court
  • any other ideas?

Temp, the court should probably be located in the Headquarters, which is in Terrengar.

On the contrary Osamafune, most commonly International Courts in the real world are located in the Netherlands and Switzerland while an institution of the UN. Terrangar should not have a monopoly of all land designated IPO.

Furthermore, I will send representatives upon the establishment of this court. I suggest the International Court of Justice be declared the name of this court, as I always found the acronym ICJ to flow quite well.

ICJ is fine, but how will it be arranged? that's the tricky question, a triad of elected juries? juries elected from all member nations? each nation's supreme court leader?

The Illuminate would prefer the court to operate under the inquisitorial model, instead of the adversarial. This would deny the importance of lawyers and place the verdict more firmly in the hands of the judges.

I agree with you, any objects to using this method?

The pool of judges is the head judge from each nation, and two other justice officials (other judges and lowers) shall be the pool of juries.

ooc: Namewise: International Court Organization Committee (ICOC)

All courts need a set of laws to base it's judgment on. What for ours?

ooc: I suggest we begin discussing more treaties, such as a geneva convention declaring the rights of POW's and a treaty defining war crimes.

OOC: Do that

Thank you all members for sending your representatives. This is how it works: you sent three main judicial experts from your nations (along with support staff). The head of your national team is on the panel of judges that from this pool, three judges are picked for each case (excluding judges that are an interest in the case such as nationality etc) and the two judicial experts make up the prosecution (and if needed) and the defense councils for any cases.

A head judge is chosen by a vote from all the judicial experts - the first head judge is the head of the judicial team from Templarios.

We are using the inquisitorial model, instead of the adversarial. This would deny the importance of lawyers and place the verdict more firmly in the hands of the judges.

Any comments and questions on this being the accepted way forward?

formalize that into a treaty or agreement so we can vote on, nothing is established here without a poll
